1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SolStrike ("Company," "we," "us," or "our") governing your access to and use of the SolStrike trading bot platform, website, and all related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

1.1 Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our platform or via email. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.

2 Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be a resident of or located in any jurisdiction where use of our Services is prohibited
• Not be on any sanctions list or subject to economic sanctions
• Have a compatible Solana wallet (Phantom, Solflare, or WalletConnect-compatible)

2.1 Geographic Restrictions

Our Services are not available to users in the following jurisdictions:

• United States of America (including all territories)
• Countries subject to comprehensive OFAC sanctions (Cuba, Iran, North Korea, Syria, Crimea region)
• Any jurisdiction where cryptocurrency trading is prohibited by law

By using our Services, you represent and warrant that you are not located in, under the control of, or a national or resident of any restricted jurisdiction.

3 Description of Services

SolStrike provides an automated trading bot platform for the Solana blockchain ecosystem. Our Services include:

3.1 Core Features

• Token Sniping: Automated detection and purchase of newly launched tokens
• Auto-Buy/Sell: Configurable automated trading based on your parameters
• Copy Trading: Ability to mirror trades from specified wallet addresses
• MEV Protection: Protection against sandwich attacks and front-running (Pro/Enterprise)
• Multi-Platform Support: Integration with Raydium, Jupiter, Pump.fun, Orca, DexScreener, and Bonk.fun
• Analytics Dashboard: Real-time portfolio tracking and performance metrics

3.2 Non-Custodial Nature

SolStrike is a non-custodial platform. This means:

• We never have access to your private keys or seed phrases
• You maintain full control of your wallet and funds at all times
• Transactions require your wallet's signature
• We cannot recover lost wallet credentials

3.3 Service Availability

While we strive for continuous availability, we do not guarantee uninterrupted access to our Services. We may:

• Perform scheduled or emergency maintenance
• Experience downtime due to blockchain network issues
• Modify, suspend, or discontinue features without prior notice

4 Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by connecting your Solana wallet. You agree to:

• Provide accurate and complete information
• Maintain the security of your wallet credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Security

You are solely responsible for:

• Safeguarding your private keys and seed phrases
• Using secure devices and networks
• Enabling available security features (hardware wallets recommended)
• Any losses resulting from compromised credentials

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms or any applicable laws
• Engage in fraudulent or abusive behavior
• Attempt to manipulate or exploit our Services
• Fail to pay subscription fees when due

5 Subscription and Payments

5.1 Subscription Plans

We offer the following subscription tiers:

• All payments are made in SOL, USDC, or USDT on the Solana blockchain
• Subscriptions are activated immediately upon confirmed payment
• Subscription periods run for 30 days from the payment date
• We do not accept credit cards or fiat currency

We reserve the right to modify subscription prices. Existing subscribers will be notified at least 30 days before any price increase affects their renewal.

6 User Conduct

When using our Services, you agree not to:

• Attempt to exploit, hack, or reverse-engineer our platform
• Interfere with or disrupt the Services or servers

• Share account credentials or allow unauthorized access
• Harass, abuse, or harm other users or our staff
• Use the Services for money laundering or terrorist financing
• Infringe on any third-party intellectual property rights

6.2 Compliance

You are solely responsible for ensuring your use of our Services complies with all applicable laws and regulations in your jurisdiction, including but not limited to:

• Securities laws and regulations
• Tax reporting and payment obligations
• Anti-money laundering (AML) requirements
• Know Your Customer (KYC) obligations

7 Risk Disclosure

7.1 Trading Risks

By using our Services, you acknowledge and accept the following risks:

• Market Volatility: Cryptocurrency prices can fluctuate dramatically in short periods
• Liquidity Risk: You may not be able to sell tokens at desired prices
• Smart Contract Risk: Bugs or exploits in token contracts can result in total loss
• Rug Pulls: Token creators may abandon projects and drain liquidity
• Regulatory Risk: Changes in laws may affect your ability to trade
• Technical Failures: System outages may prevent timely execution of trades
• Slippage: Actual execution prices may differ from expected prices

7.2 No Guarantees

We do not guarantee:

• Any level of profit or return on investment
• Successful execution of any trade
• Accuracy of any analytics or predictions
• Performance of any token or trading strategy

Past performance is not indicative of future results. Any statistics, success rates, or performance metrics shown are historical and do not guarantee future outcomes.

8 Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOLSTRIKE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Trading losses or missed opportunities
• Damages exceeding the amount you paid us in the 12 months preceding the claim

8.3 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, blockchain network failures, or government actions.

9 Indemnification

You agree to indemnify, defend, and hold harmless SolStrike and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your trading activities and their outcomes
• Any claims by third parties related to your actions

10 Intellectual Property

10.1 Our Rights

All intellectual property rights in the Services, including but not limited to software, algorithms, designs, logos, and content, are owned by SolStrike or its licensors. You may not:

• Copy, modify, or distribute our proprietary materials
• Reverse engineer or decompile our software
• Use our trademarks without written permission
• Remove or alter any proprietary notices

10.2 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial trading activities.

11 Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12 Termination

Either party may terminate this agreement at any time:

• By You: You may stop using the Services and close your account at any time
• By Us: We may suspend or terminate your access immediately for violations or at our discretion

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect, including Sections 7-9, 11, and 14.

13 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to its conflict of law provisions.

14 Dispute Resolution

14.1 Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by a mutually agreed arbitration institution.

14.2 Class Action Waiver

14.3 Informal Resolution

Before initiating arbitration, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

15 General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and SolStrike
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign your rights without our consent; we may assign ours freely
• No Partnership: These Terms do not create any partnership, joint venture, or agency relationship
